  1. This Invitation for Tenderers follows the General Procurement Notice for this Project which was published on the European Bank for Reconstruction and Development website, Procurement Notices dated 12/06/2017 (Ref: 8723-GPN-47947).

The Private Joint-Stock Company “Ukrhydroenergo”, hereinafter referred to as “the Purchaser”, intends to use part of the proceeds of the loans from the European Bank for Reconstruction and Development (EBRD) and the European Investment Bank (EIB) towards the cost of Hydro Power Plants Rehabilitation Project.

The Purchaser now invites sealed Tenders from Contractors for the following Contract to be funded from part of the proceeds of the loan:

Supply and Installation of Automated Dam Safety Monitoring System for Kyiv PSPP

The maximum Completion period is: 52 weeks

  1. Tendering for Contracts to be financed with the proceeds of the loans from the Banks is open to firms from all countries. The proceeds of the Bank’s loan will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations.

  1. The provisions in the Instructions to Tenderers and in the General Conditions of Contract are the provisions of the European Bank for Reconstruction and Development Standard Tender Documents for Supply and Installation of Plant and Equipment, revision January 2015.

  1. International competitive tendering will be conducted in accordance with the European Bank for Reconstruction and Development single-stage Tendering Procedure without pre-qualification.

  1. The Tenderers shall meet the following minimum qualification criteria:

  1. Eligibility criteria:

  1. No- conflicts of interests

  2. Not having been declared ineligible by the Bank

  3. Not having been excluded by an act of compliance with UN Security Council resolution

  4. Historical Contract non-performance criteria and pending litigation

  1. The Tenderer, or any partner in a Joint Venture; Consortium or Association, shall not have a consistent history of litigation and/arbitration resulting in awards against the Tenderer, or any parent in a Joint Venture; Consortium or Association, within the last 3 (three) years.

  2. Total amount of all pending litigations and unsatisfied judgments held not in favour of the Tenderer, which are in legal force, shall not represent more than twenty five percent (25%) of the Tenderer’s net worth in total.

  1. Financial criteria:

  1. current soundness of Tenderers financial position and its prospective long term profitability;

  2. average annual turnover, within the last three (3) years, representing not less than two million Euros (EUR 2’000’000.00);

  3. financial resources sufficient to meet:

  4. the following minimum cash-flow requirement: three hundred thousand Euros (EUR 300.000);

  5. the overall cash flow requirements for this Contract and its current works commitment.

  6. Annual commitment value under current contracts and pending contract awards to be carried out in parallel with Contract under this Tender shall not exceed Tenderer’s Turnover for the last year more than time and half (1,5).

  1. Experience criteria:

  1. General experience under contracts in the role of contractor, subcontractor, or management contractor for at least the last five (5) years, and with activity in at least nine (9) months in each year in each year in the field of rehabilitation and construction of Automated Safety Monitoring System (ASMS) for dams;

  2. Specific minimum experience of participation as contractor, management contractor or subcontractor, for the design, supply, installation and commissioning of new or rehabilitated Automated Safety Monitoring System (ASMS) for two (2) dams within the last five (5) years, that have been successfully completed and that are similar to the proposed Plant and Equipment, Installation and other services.

The similarity shall be based on the physical size, complexity, methods/technology or other characteristics as described in the relevant Tender Documents.

  1. Specific minimum experience in the following key activities:

  2. Design of Automated Safety Monitoring System (ASMS) for dams;

  3. Supply of Automated Safety Monitoring System (ASMS) for dams;

  4. Installation of Automated Safety Monitoring System (ASMS) for dams;

  5. Testing, commissioning and settings of Automated Safety Monitoring System (ASMS) for dams.

The individual contracts/works should be not less than six hundred thousand (600 000) EUR

  1. Personnel:

The Tenderer shall provide suitably qualified personnel to fill the following positions: Contractor’s representative, Design Manager, Software Engineer, Construction Manager and Commissioning Engineer for Automated Safety Monitoring System (ASMS). For each of these six positions, the Tenderer shall provide information on a principal candidate and an alternate, each of whom should meet the experience requirements specified below:

  1. Quality Management System (QMS) criteria:

Tenderers shall have and maintain during the whole contract performance a QMS in accordance with ISO 9000 standards requirements or equivalent.

  1. Subcontractors

  1. Subcontractors in charge of the Major Items of Plant and Equipment, Installation and other Services, must comply with experience criteria (ii) and (iii) and with QMS criteria, for the part of which they are concerned.

ForMinimum specific experience in key activities, the Tenderer can use the qualification of the Subcontractors to substitute the qualification of the Bidder itself, provided that the Tenderer can demonstrate its own experience as a management contractor directly in charge of supervision of such subcontracted part in contracts for at least two (2) new or rehabilitated Automated Safety Monitoring System (ASMS) for dams over the last five years that have been successfully completed and that are similar to the proposed Plant and Equipment, Installation and other services. At least one (1) of these references must include supervision of the proposed Subcontractor.

Otherwise, qualification of Subcontractors must be demonstrated in addition to the qualification of the Tenderer itself.

  1. Subcontractors which part represents more than 25% of the Bid Price must fulfil at least 25% of financial criteria (i), (ii) and (iii);

  2. For each Subcontractor mentioned in paragraphs (i) and/or (ii) here above the Tenderer shall provide Manufacturer’s Authorization showing that the Tenderer has been duly authorized by the manufacturer of the related plant or equipment or components to supply or install that item in the Employer’s country.

These qualification requirements are detailed in the Tender Documents.

  1. The scope of works basically includes:

  • Design, supply, installation, setting, testing and commissioning of the remote sensors;

  • Supply of the programs to enable automatic and periodical scan of internal and meteorological sensors;

  • Design, supply, installation, setting, testing and commissioning of hardware and software for data acquisition from spatial geodetic sensors and inclinometers;

  • Supply of all technical documentation

  • Training of Employer’s personnel

  1. A complete set of Tender Documents in English may be purchased by interested Tenderers on the submission of a written application to the address below upon payment of a non-refundable fee of 270euros (two hundred seventy EUR) (not taking into account bank fees). For residents of Ukraine the payment is performed in UAH in accordance with official currency exchange rate (Euro) of National Bank of Ukraine as of the date of invoice issuance This set will include:

  3. Electronic version in pdf in English without drawings (with Price and Time Schedules in Excel format and Tender forms in MS Word)

  4. Electronic version in pdf in Ukrainian or in Russian with drawings (with Price and Time Schedules in Excel format and Tender forms in MS Word).

The hard copy in English is the only official version of Tender Documents. In case of discrepancy, this version shall prevail.

  1. Upon receiving appropriate evidence of payment of the non-refundable fee, the documents will be promptly dispatched by courier; however, no liability can be accepted for loss or late delivery. Also the documents will be dispatched electronically. In the event of any discrepancy between electronic and hard copies of the documents, the hard copy shall prevail.
